Emailing US contacts: CAN-SPAM basics

Commercial email to US recipients falls under the CAN-SPAM Act. It doesn’t require prior opt-in for B2B email, but every message must follow a few rules — and the US Federal Trade Commission enforces them per email.

• Don’t use false or misleading header information or subject lines.
• Identify the message as an advertisement where it is one.
• Include a valid physical postal address for your business.
• Give a clear way to opt out, and honour opt-outs within 10 business days.
• You’re responsible for compliance even if an agency sends on your behalf.
